TERMS & CONDITIONS FOR ADVERTISERS
By submitting your advertising details to My Kid’s Party for publication you are indicating:
- That you are the legal owner of the business or services to be advertised or you have legal power of attorney on behalf of the business owner/advertiser.
- That you agree to My Kid’s Party publishing these details for you.
- That the details supplied by you are true and accurate and not misleading in any way.
* That My Kid’s Party reserves the right to decline or modify any advertisement it considers improper or out of unison with the general nature of the website. The final decision on all advertising material remains at the discretion of My Kid’s Party but will however be completed in consultation with the advertiser.
In respect to any advertising details or photographs submitted by you for publication, you confirm that you own full title to such details and/or photographs and you agree to grant a copyright license to My Kid’s Party.
Note that you cannot use photographs from exterior sources to your company without the express permission of the photographic source – it is the advertiser’s responsibility to ensure they have copyright over any materials supplied to us for publication on their behalf and you agree to indemnify My Kid’s Party in respect of any claims against us or expenses incurred by us in respect of breach of copyright issues.
Photographs, images, advertising company descriptions and all other content published on this website specifically for My Kid’s Party are copyright of My Kid’s Party and may not be copied from this site and reproduced in any other advertisement or marketing, without our written consent, please address your requests to firstname.lastname@example.org.
All intellectual property rights are owned by My Kid’s Party as permitted by law. My Kid’s Party is the owner of the My Kid’s Party site including text, graphics, logos, copyright, trademarks and all other intellectual property rights in the material displayed or made available through the site.
LIABILITY AND INDEMNITY
Advertisers indemnify My Kid’s Party against all claims, demands, proceedings and other liability arising wholly or partially, directly or indirectly from the publication of the advertising material. Advertisers indemnify My Kid’s Party against any claims arising from; infringement of copyright, infringement of trade marks or names of publication titles, unfair competition, breach of trade practices, privacy or fair trading legislation and violation of rights of privacy or confidential information or licenses or royalty rights or other intellectual property rights.
The Advertiser indemnifies My Kid’s Party for any loss or damage including indirect or consequential loss or damage regardless of its cause (including negligence and tort) arising out of or in any way connected with the supply of or failure to supply the advertising service.
YOUR PRIVACY AND SECURITY
Your personal details are kept private and only those details you wish to be published are made available to our site visitors. We will never share your information with any third party or business. You have a right under the Privacy Act 1993 to access any personal information held about you or to request us to delete any such information.
ACCURATE COMPANY DESCRIPTIONS
All advertising details supplied by owners to us must be true and accurate.
We reserve the right to edit any descriptions where there is a potential for misunderstanding. Before posting your details on our website we check all listings and may make amendments to improve presentation, correct spelling and other obvious errors. The company description/advertising should only provide a factual breakdown of the business features you wish to promote. The factual accuracy of the information supplied for publication on this site, is the responsibility of the advertiser and you agree to indemnify My Kid’s Party against any claims or expenses arising from misleading or inaccurate claims made by you about your company within the advertising published. The space is to be used solely for advertising the business of the advertiser for kid’s parties and shall not include any other matter.
TIME OF TERM – UPDATING INFORMATION
Your standard listing will be advertised on our website indefinitely. Therefore, we ask that you keep us informed of any changes to your circumstances and the information your listing contains. It is the business owner’s responsibility to ensure their listing is up to date, true and accurate. My Kid’s Party will not be making ongoing checks of listings details. If it comes to our attention that information on your listing is out-dated and incorrect we will need to up-date this information. All updates will incur a $30 administration fee. These will not be undertaken without consultation and consent from the business owner. My Kid’s Party will email an annual reminder to advertisers to check their listing is still true and accurate.
If you wish to end your listing with My Kid’s Party you can do so at any time. You are under no obligation to keep your listing on My Kid’s Party for any length of time. If you wish to cease your listing you need to contact My Kid’s Party to inform us of this. You are under obligation to inform My Kid’s Party if you are no longer providing your service or business and therefore need your listing removed. My Kid’s Party reserves the right to remove a business from the site at anytime, for any reason and without liability to My Kid’s Party.
INTERRUPTION IN SERVICE
My Kid’s Party makes every reasonable effort to ensure that our website facilities are available to internet visitors and customers at all times. However, we do not offer any guaranteed percentage time of availability and accept no financial liability for any interruption in service or temporary loss of some or all website facilities at any time. On occasion, necessary maintenance or upgrade work requires the site to be taken ‘off-line’ without notice, but we endeavour to keep downtime to a minimum and in most cases of scheduled maintenance, this normally involves no more than a few minutes.
Any cancellation request within fourteen days of the commencement of the ‘Paid Advertising’ will incur a cancellation fee of 50% of the value of the advertising. Any cancellation request made within seven days of the commencement of the ‘Paid Advertising’ will incur a cancellation fee of 70% of the value of the advertising. My Kid’s Party retains its rights to take any action necessary to recover unpaid fees and charges. At which time all costs including debt collection, commission, solicitors fees and any expense will be the liability of the Advertiser.
If you experience any problem using our service, or we make an error in publication, let us know straight away and we will correct the problem asap. Please quote your full name and business name in all communications. We aim to respond to all enquiries within two working day.
